Do medical device distributors need to register with FDA?

Whether a medical-device distributor must register with the FDA depends on its operational role. A domestic wholesale distributor that buys compliant finished devices in the United States and resells them without importing, manufacturing, repackaging, or changing their labeling is generally not required to register or list devices.

Registration requirements may apply when a distributor:
✓ Takes first possession of devices imported into the United States
✓ Repackages finished devices into different containers
✓ Changes labeling for distribution under its own brand
✓ Develops device specifications and arranges contract manufacturing
✓ Manufactures, assembles, sterilizes, or remanufactures devices
✓ Reprocesses devices labeled for single use

An initial importer must have a staffed physical address in the United States, register its establishment, identify the foreign manufacturers it represents, maintain complaint-related records, and satisfy applicable Medical Device Reporting requirements. A customs broker or import agent that does not take first possession normally is not treated as an initial importer.

Simply adding a distributor’s name without changing the original labeling does not necessarily make the company a relabeler. However, private-label arrangements require closer review because the brand owner may qualify as a specification developer or relabeler.

Companies should document their exact activities, ownership of the specifications, labeling control, import role, and product flow before determining their status. FDA registration classifications cannot be selected reliably from a company title such as “distributor” alone.
